TERMS AND CONDITIONS OF TRAVEL


NOTE!

These travel conditions are Flyingfox’s general travel conditions. A separate travel contract is concluded for each upcoming trip. In case there are differences between the travel contract and the general conditions, the travel contract will be followed.

1.TRAVEL CONTRACT

1.1 The travel contract is an agreement between Flyingfox and the passenger that outlines the terms and conditions of travel.

2.PAYMENT FOR TRAVEL

2.1 The travel contract comes into effect when the passenger selects the trip, receives a travel confirmation, and makes an advance payment as follows.
2.1.1 If the trip is more than 90 days away, an advance payment of up to 10% of the total cost of the travel package must be made within 3 working days.
2.1.2 Once the advance payment has been made, the balance must be paid no later than 30 days before the date of travel. The detailed payment terms will be agreed upon by the parties.

3.TRAVEL PRICE AND PRICE CHANGES

3.1 The travel price includes the services described in the travel information materials.
3.2 The passenger is not entitled to claim compensation from the tour operator if they do not use some of the services included in the package price.
3.3 The tour operator reserves the right to change the price of the travel package in the following circumstances:
3.3.1 Changes in the price of transport or accommodation outside the control of the organizer.
3.3.2 Significant changes in exchange rates. 3.4 Any change to the travel charge must be notified to the customer at the earliest opportunity, but not less than 21 days before the start of the journey.
3.5 The price guarantee protects the passenger against unexpected price increases and is valid if the passenger pays the total cost at the time of booking. The prerequisite is that there are more than 30 days until the trip.

4.PASSENGER’S RIGHTS TO MODIFY OR CANCEL THE TRIP

4.1 The passenger has the right to cancel the reservation without prejudice under the following conditions:
4.1.1 If there is a price increase of at least 150% of the price of the package or a significant change to the travel service, passengers must notify their intention to cancel within 48 hours of receiving notice of a price increase or significant change.
4.2 The passenger has the right to cancel the order under other conditions, in which case the tour operator will calculate the charge as follows:
4.2.1 If the cancellation is made more than 30 days before the start of the trip, the tour operator will retain 50% of the advance payment to cover organizational costs.
4.2.2 If the cancellation is made 30 days before the start of the trip, 25% of the amount paid will be refunded to the customer.
4.2.3 If the cancellation is made less than 30 days before the start of the trip, the operator reserves the right to retain the full amount of the travel cost.
4.3 The passenger has the right to change the passenger’s name, travel date and destination up to 30 days before departure free of charge. Changing the name 30 days before the start of the trip costs 500 euros.
4.4 Failure to issue a visa to a passenger shall be considered as a cancellation of the journey without any impediment and the provisions of Section 4.2 of these Terms and Conditions of Travel shall apply.

5.PASSENGER’S OBLIGATIONS AND RESPONSIBILITIES

5.1 The passenger undertakes to familiarize themselves with the travel information materials, the conditions of travel, and the tips for travel.
5.2 The passenger undertakes to comply with the travel instructions, departure times, and rules of hotels and means of transport.
5.3 It is the passenger’s responsibility to obtain travel insurance. 5.4 If the passenger falls ill or suffers an accident during the trip, the tour operator will assist the passenger in arranging medical care and, if necessary, an early return. However, the passenger will be liable to pay the tour operator for any additional costs incurred.
5.5 The passenger is responsible for the correctness of their travel documents. If a trip is canceled due to invalid documents, the tour operator will apply cancellation rates based on the provisions of clause 4.2 above.

6.THE TOUR OPERATOR’S OBLIGATIONS AND RESPONSIBILITIES

6.1 It is the responsibility of the tour operator to ensure that the travel is as described and as promised to the customer.
6.2 The tour operator is not liable for damage caused by the passenger’s own negligence, actions or inactions.
6.3 The tour operator is not liable for damage caused by force majeure (natural disasters, wars, strikes, etc.). Either contracting party may terminate the contract if the provision of the travel service becomes impossible or unsafe due to force majeure.

7.THE TOUR OPERATOR’S RIGHTS

7.1 The tour operator has the right to make changes to the itinerary (change of hotel, means of transport, destination airport, and change of timetable) for reasons beyond their control, if the quality and nature of the trip are not substantially affected. Changes must be notified to the passenger immediately.
7.2 The tour operator has the right to cancel the trip if it is caused by force majeure at or near the destination or if the safety of passengers is endangered (war, riots, natural disasters, etc.).

8.DEFICIENCIES AND HOW TO REPORT THEM

8.1 A deficiency in the travel arrangements is considered to occur if the trip does not correspond to what was agreed in advance in terms of services and other arrangements.
8.2 The following circumstances may not be considered as deficiencies in travel arrangements:
8.2.1 Changes that are insignificant from the point of view of the trip as a whole, which can be expected considering the destination and the nature of the trip (change of airports, delays due to weather conditions, traffic jams, etc.).
8.2.2 The passenger is denied boarding or disembarkation in the country of destination through no fault of their own (lost ticket, refusal to disembark, invalid or lost passport, severe intoxication, etc.).
8.3 Any deficiencies that can be remedied at the destination must be reported immediately to the travel agent or service provider. If no solution can be found on the spot, a written complaint must be submitted to the tour operator no later than 10 days after the end of the trip. If the passenger wishes to be compensated for a missed and/or unsatisfactory service, they must attach to their complaint the original receipts or other evidence of clearly justified additional costs.

9.VALIDITY OF THE TERMS AND CONDITIONS OF TRAVEL AND SETTLEMENT OF DISPUTES

9.1 These general terms and conditions of the travel contract form an integral part of the travel contract concluded between the tour operator and the passenger and enter into force from the conclusion of the travel contract. Disagreements between the parties shall first be resolved by negotiation.
